| 1.1 | Bazomb Inc. (“Bazomb” or “we” or “us” or “our”) recognizes the importance of protecting the privacy of all information provided to us and to our clients through the use of our services and related website (the "Site"). We created the following policy guidelines to govern our relationship with our users and consumers (collectively or individually, "Consumers") who use any of the websites or services provided by Bazomb. |
| 1.2 | By using or accessing the Site, you are acknowledging and accepting the practices described in this Privacy Policy. Please note that we may update this Privacy Policy as we change and/or develop the Site. By accessing and using the Site you acknowledge your acceptance of the then-current Privacy Policy and Website Terms of Use. For this reason, we recommend that you review the Privacy Policy from time to time to ensure that you understand and accept our current privacy practices. |
| 1.3 | Bazomb uses commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of your personal information. However, no data transmitted over the Internet or a wireless network is 100 percent secure. We cannot ensure or warrant the security of information that you transmit to Bazomb or the Site. All information transmitted is transmitted at your own risk. Once we receive your transmission of information, Bazomb makes commercially reasonable efforts to ensure the security of our systems. However, please note that this is not a guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. |
| Section 2. | The Information We Collect |
| 2.1 | Bazomb may collect information when you order a product or service; contact customer service for support; create an account; send feedback or request information; participate in a survey, contest, or promotion; and/or for purposes of fulfilling your requests to participate in certain offers and promotions. The type of information collected will depend on the information you provide, as well as any automatically collected or data-tracking information. |
| 2.2 | Consumer Provided Information: When you visit the Site, you may provide Bazomb with "personally identifiable" information. This may include, but is not limited to, your name, e-mail address, postal mailing address, date of birth, and telephone number. This information may be required to purchase an offer or print a coupon from, or otherwise participate in activities offered on, the Site. In addition, you may provide us with certain demographic information about yourself, such as age, gender, household income, interests, zip code, and state. |
| 2.3 | Financial Information: For certain services, such as to purchase an offer, we require credit card or other payment account information. Financial data is maintained by our payment processor in encrypted form on secure servers. We do not share this information with any third party except the companies responsible for processing our credit card transactions. |
| 2.4 | "Cookies" Information: When you visit the Site, we may send one or more cookies to your computer. A cookie is a small file that is stored on your computer for record-keeping purposes. Bazomb uses both session cookies and persistent cookies. Session cookies last only as long as your browser session, and are deleted as soon as you close your browser. A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to the Site. Persistent cookies can be removed by modifying your browser settings to delete cookies. We do not link the information we store in cookies to any personally identifiable information you may submit while on our site. |
| 2.5 | "Automatically Collected" Information: When you use the Site or open one of our HTML e-mails, we may automatically record certain data using technology, including "clear gifs" or "web beacons," cookies, IP addresses, unique device IDs, and log files. "Automatically Collected" data includes voucher/coupon printing and redemption activity, web browser type, the website that referred you to us, the web pages you viewed on the Site, and the dates and times that you visited the Site. |
| 2.6 | Refer-a-Friend/Gift Purchases: If you choose to use our referral service or purchase a deal for a friend, we will ask you for your friend's name and e-mail address. Your friend will receive a one-time e-mail from us with the gift you bought for them or invitation to visit the Site. Bazomb stores the information you provide for the sole purpose of sending this one-time e-mail, sending the gift, and collecting statistical data for the referral program. Your friend may contact us to request that we remove this information from our database. |
| Section 3. | The Way We Use Information |
| 3.1 | Bazomb uses the collected information to operate and maintain the Site and Services; to provide you with all of the coupons and promotional offerings found on the Site; for other non-marketing or administrative purposes such as notifying you of major service updates or for customer service purposes; to understand usage trends and preferences; to improve the way the Site works and looks; to improve our marketing and promotional efforts; and to create new features and functionality. |
| 3.2 | Bazomb uses "automatically collected" data to process and record voucher/coupon printing and redemption activity; store information so that you will not have to re-enter it during your subsequent visits to the Site; provide custom, personalized promotions, advertisements, content, and information; monitor the effectiveness of marketing campaigns and aggregate usage metrics. |
| 3.3 | Bazomb will not use your e-mail address or other personally identifiable information that you provide directly to us to send promotional or marketing messages without your consent except as part of a specific program or feature for which you will have the ability to opt-out. |
| Section 4. | When We Disclose Information |
| 4.1 | Bazomb discloses "automatically collected" data to its Clients and third-party ad servers and advertisers. Aggregated, non-personal information about Consumer use of the site may be provided to third parties. Such information will not personally identify a specific Consumer. We do not share "personally identifiable" information with other third-party organizations for their marketing or promotional uses without your consent except as part of a specific program or feature for which you will have the ability to opt-out. |
| 4.2 | In limited circumstances, Bazomb discloses both "personally identifiable" and "automatically collected" information to our clients, affiliated companies, or other businesses or persons. This information may be provided to process information on our behalf; to provide website maintenance and security; to enable us to fulfill voucher/coupon requests and sweepstakes or contest winnings; to offer certain features on the Site; to assist us in improving the way the Site works and looks; to process credit card or financial information; and to create new features. We require that these parties agree to process such information in compliance with our Privacy Policy. We use reasonable efforts to limit their use of such information, and we require these parties to use any other appropriate confidentiality and security measures. |
| 4.3 | We may disclose Consumer information if required to do so by law or in the good-faith belief that such action is necessary to comply with state and federal laws or respond to a court order, judicial or other government subpoena, or warrant. |
| 4.4 | We reserve the right to disclose Consumer information that we believe, in good faith, is appropriate or necessary to take precautions against liability; protect clients from fraudulent, abusive, or unlawful uses; to investigate and defend ourselves against any third-party claims or allegations; to assist government enforcement agencies; to protect the security or integrity of the Site; and to protect against fraudulent uses, the rights, property, or personal safety of Bazomb Inc., our clients, or others. |
| 4.5 | In the event that Bazomb is acquired by or merged with a third-party entity, we reserve the right to transfer or assign the information we have collected from our Consumers, including "personally identifiable" information, as part of such merger, acquisition, sale, or other change of control. |
| Section 5. | Actions |
| 5.1 | We provide you the opportunity to “opt-out” of having your "personally identifiable" information used for certain purposes, when we ask for this information. You will be notified when your personal information is collected by any third party that is not our agent/service provider, so you can make an informed choice as to whether or not to share your information with that party. |
| 5.2 | If you no longer wish to receive our e-mail alerts and promotional communications, you may opt-out of receiving them by following the instructions included in each e-mail communication or by contacting us at the postal address at the bottom of this Policy. |
| 5.3 | You may always choose not to share personal information. In some cases if you decline to share personal information on the Site, Bazomb will not be able to provide certain services to you on the Site. |
| 5.4 | You may update, correct, or delete your personal information and preferences at any time by going to the edit profile section of the website from which you are printing or redeeming vouchers/coupons. |
| 5.5 | To protect your privacy and security, we take reasonable steps to verify your identity before granting access to personal information or before making corrections. You are responsible for maintaining the secrecy of your account information and unique password. |
| Section 6. | Special Notice to California Users |
| 6.1 | California law requires that we provide you with a summary of your privacy rights under the California Online Privacy Protection Act (the “Act”) and the California Business and Professions Code. |
| 6.2 | California law requires us to inform you, at your request, (1) the categories of "personally identifiable" information we collect and what third parties we share that information with; (2) the names and addresses of those third parties; and (3) examples of the products marketed by those companies. The Act further requires us to allow you to control who you do not want us to share that information with. To obtain this information, please send a request by e-mail or standard mail to the address below. When contacting us, please indicate your name, address, e-mail address, and what "personally identifiable" information you do not want us to share with Affiliated Businesses or Marketing Partners. The request should be labeled “California Customer Choice Notice.” We will respond to your inquiry within thirty (30) days of its receipt. There is no charge for controlling the distribution of your Personally Identifiable Information or requesting this notice. |
| Section 7. | Our Commitment to Children's Privacy |
| Bazomb Inc. is interested in protecting the privacy of children and does not knowingly collect or maintain information from persons under 18 years of age. No part of the Site is structured to attract anyone under 18. Products advertised or offered for children under the age of 18 are intended to be purchased by adults. If Bazomb learns that "personally identifiable" information of persons under 18 years of age has been collected on the Site without verified parental consent, then Bazomb will delete this information. If you are at least 13 years of age but not yet 18, you may use the Site with the permission of your parent or guardian. No one under the age of 13 may use the Site, under any conditions. | |
